These Terms & Conditions (“Terms”) apply to bookings, enquiries and services arranged through the Himalaya Wheels website, platform, forms, customer service channels or other booking methods.
By submitting a booking request, making a booking, paying for a service, or otherwise using a service arranged through Himalaya Wheels, the person making the booking and each person using the relevant service (“Customer”, “you” or “your”) agrees to these Terms.
These Terms should be read together with the applicable booking confirmation, quotation, vehicle-specific conditions, cancellation and refund conditions, and any other terms specifically provided to you for your booking.
1. ABOUT HIMALAYA WHEELS
Himalaya Wheels is an Australia-based vehicle rental, transportation and travel-services booking and facilitation platform connecting customers with vehicle rental companies, vehicle owners, fleet operators, drivers, travel agents and other service providers in Nepal (“Partners”).
Himalaya Wheels may facilitate or coordinate services including:
- self-drive vehicle rentals
- chauffeur-driven vehicle hire
- airport pickup and drop-off
- point-to-point transportation
- one-way vehicle rentals
- corporate, NGO, embassy and organisational vehicle services
- tours and sightseeing experiences
- day trips and excursions
- tour packages and travel experiences arranged through third-party providers
- flight enquiries and referrals to travel agents
- other travel-related services arranged through third-party providers
- other vehicle, transportation, tourism or travel-related services offered through the platform
Himalaya Wheels does not own or directly operate every vehicle or transportation service available through the platform. Depending on the service booked, the physical vehicle, driver, transportation, tour or other service may be supplied by an independent Partner.
Himalaya Wheels may facilitate and coordinate bookings, communications, payments where applicable, customer support and Partner coordination.
Nothing in these Terms is intended to exclude or limit any rights or remedies that cannot lawfully be excluded under applicable law.
2. HIMALAYA WHEELS AND PARTNER RESPONSIBILITIES
2.1 Himalaya Wheels
Depending on the service, Himalaya Wheels may:
- provide the booking platform
- receive and process booking requests
- communicate booking information between Customers and Partners
- facilitate or process payments where applicable
- collect and hold security deposits where applicable
- provide customer support
- coordinate with Partners
- assist with booking changes and cancellations
- assist with complaints or service issues
2.2 Partner Responsibilities
Where a vehicle or other physical service is provided by a Partner, the Partner is responsible for providing the agreed service and for matters within its reasonable operational control, including the vehicle, driver, required licences and permits, vehicle condition, insurance and compliance with applicable laws.
Himalaya Wheels works with Partners and may take reasonable steps to monitor service standards and address Customer concerns.
Nothing in these Terms limits any rights or remedies that cannot lawfully be excluded under applicable law.
3. BOOKINGS AND CONFIRMATION
A booking request submitted through Himalaya Wheels is not necessarily a confirmed booking.
A booking becomes confirmed only when Himalaya Wheels or the relevant Partner has confirmed the booking and any applicable payment, deposit or other booking requirements have been satisfied.
Your booking confirmation may specify:
- vehicle
- service type
- rental dates and times
- pickup and return locations
- price
- security deposit requirements
- included kilometres or mileage
- driver arrangements
- additional charges
- other applicable conditions
Customers should check their booking confirmation carefully and notify Himalaya Wheels promptly if any information is incorrect.
4. VEHICLE CATEGORIES, IMAGES AND INFORMATION
Vehicle descriptions, specifications, photographs and illustrations are provided as a general guide.
Actual vehicles may vary in:
- colour
- model year
- trim
- equipment
- accessories
- seating configuration
- other minor specifications
Where a specific vehicle is expressly guaranteed in the booking confirmation, reasonable efforts will be made to provide that vehicle.
Where a vehicle becomes unavailable, Section 25 may apply.
5. SELF-DRIVE RENTALS
For self-drive rentals, the Customer is responsible for the vehicle during the rental period from the time of handover until the vehicle is properly returned and accepted by the Partner.
The Customer must:
- comply with all applicable laws
- operate the vehicle responsibly
- hold the required driving licence
- comply with applicable age requirements
- use the vehicle only for lawful purposes
- follow the Partner’s reasonable instructions
- take reasonable care of the vehicle
- promptly report accidents, damage, breakdowns or other significant incidents
The Customer must not allow an unauthorised person to drive the vehicle.
6. CHAUFFEUR-DRIVEN SERVICES
For chauffeur-driven services, the vehicle is operated by a Partner-provided driver.
The Customer must treat the driver respectfully and must not instruct the driver to:
- break traffic laws
- exceed lawful speed limits
- operate the vehicle dangerously
- undertake any unlawful activity
The driver may refuse an instruction that would be unsafe or unlawful.
7. AIRPORT TRANSFERS
Airport transfers are subject to the booking details provided by the Customer.
Customers should provide accurate:
- flight number
- arrival or departure time
- airport
- passenger details
- luggage requirements
- contact information
Customers should notify Himalaya Wheels or the relevant Partner as soon as reasonably possible if a flight is delayed, cancelled or changed.
Reasonable efforts may be made to coordinate airport transfers based on the information supplied, but Himalaya Wheels cannot guarantee that delays caused by airlines, airports, immigration, customs, traffic or other circumstances outside its reasonable control will not affect the service.
8. CUSTOMER INFORMATION
Customers must provide accurate and complete information required for the booking.
This may include:
- full name
- contact details
- driver’s licence information
- identification documents
- pickup and return information
- passenger information
- flight information
- other information reasonably required for the service
Himalaya Wheels may share necessary booking information with the relevant Partner to provide the requested service.
9. DRIVER REQUIREMENTS
Customers using self-drive services must meet the applicable minimum age, licence and driving requirements stated in the booking conditions.
Additional requirements may apply depending on:
- vehicle type
- Partner requirements
- local laws
- insurance requirements
- rental duration
Failure to meet applicable requirements may result in the vehicle being refused, subject to the applicable booking conditions and applicable law.
10. INTERNATIONAL AND OVERSEAS DRIVERS
Customers driving in Nepal using an overseas licence are responsible for ensuring that their licence and any required international driving permit or other documentation is legally valid for driving in Nepal.
The Customer must comply with all applicable Nepalese driving and licensing requirements.
Himalaya Wheels or the Partner may request supporting documentation before confirming or handing over a vehicle.
11. VEHICLE HANDOVER AND INSPECTION
The Customer should inspect the vehicle at the time of handover.
Existing damage should be recorded through the applicable inspection process, photographs, videos or other agreed documentation.
Customers should raise any apparent damage or condition issue before leaving with the vehicle.
Where reasonably possible, the Partner should document the vehicle’s condition at handover and return.
12. VEHICLE CONDITION AND USE
Customers must take reasonable care of the vehicle.
The vehicle must not be:
- overloaded
- used for unlawful purposes
- driven recklessly
- used in prohibited areas
- used for racing or speed testing
- used for towing unless authorised
- driven by an unauthorised person
- used in a manner inconsistent with the vehicle’s intended purpose
Additional restrictions may be stated in the booking confirmation or Partner conditions.
13. SECURITY DEPOSIT
A security deposit may be required for certain vehicle rental bookings. The applicable deposit amount and payment method will be communicated to the Customer before or at the time of booking.
Depending on the booking, the security deposit may be:
- collected and held by Himalaya Wheels
- where expressly permitted and stated in the booking confirmation, paid directly to the relevant Partner at the time of vehicle handover, including by cash or another approved payment method
Where a security deposit is collected and held by Himalaya Wheels, it will be handled in accordance with these Terms and the applicable booking conditions.
Where a cash or other security deposit is authorised to be paid directly to a Partner, the Partner will be responsible for receiving, recording and returning that deposit in accordance with the applicable booking conditions.
Customers should obtain confirmation or a receipt from the Partner for any security deposit paid directly at vehicle handover.
Customers must not assume that a Partner will accept a cash deposit or any other payment method unless that method has been expressly authorised or stated in the booking confirmation.
Subject to applicable law, a security deposit may be used to cover amounts properly payable by the Customer, including:
- damage to the vehicle or its equipment
- loss of the vehicle or equipment
- excessive cleaning
- fuel or refuelling charges
- additional mileage charges
- late-return charges
- traffic, parking, toll or government charges
- lost keys or accessories
- recovery, towing or related costs
- other reasonable costs arising from the Customer’s use of the vehicle
- other amounts properly payable under the booking
Where a deduction is proposed, Himalaya Wheels or the relevant Partner, depending on who holds the deposit, may provide the Customer with reasonable information or supporting evidence relating to the charge where available.
Where Himalaya Wheels holds the deposit, any remaining balance will be returned after the rental has been completed and relevant charges have been assessed.
Where the Partner holds the deposit, the Partner will return the applicable remaining balance in accordance with the booking conditions.
The timing of any refund may depend on the method used to hold and return the deposit and on the assessment of any outstanding charges.
Where a charge is identified after the security deposit has been returned, the Customer may remain responsible for that amount where permitted under these Terms and applicable law.
14. CARD PRE-AUTHORISATION
Where available and agreed for a particular booking, Himalaya Wheels may use a card pre-authorisation as a security measure.
A card pre-authorisation is a temporary hold placed on the Customer’s available credit or funds by the Customer’s card issuer or payment provider. It is not the same as a completed payment or a security deposit collected and held by Himalaya Wheels.
Where a card pre-authorisation is used, Himalaya Wheels may seek authorisation for an amount specified in the booking conditions.
The pre-authorised amount may be used to settle amounts properly payable by the Customer where permitted by the applicable payment arrangement, these Terms and applicable law.
Himalaya Wheels may release the pre-authorisation after the vehicle has been returned and the relevant booking charges have been assessed.
The timing of the release of a pre-authorisation is controlled partly by the payment provider and the Customer’s card issuer and may therefore take additional business days to become available to the Customer.
Where a pre-authorisation cannot be obtained or is declined, Himalaya Wheels may require another approved security method before the vehicle is released.
Depending on the booking, Himalaya Wheels may require either:
- a refundable security deposit collected and held by Himalaya Wheels
- a card pre-authorisation
- another security arrangement expressly approved by Himalaya Wheels
Customers must follow the security deposit or pre-authorisation method specified in their booking confirmation.
15. PAYMENTS
The applicable booking price, deposit and other charges will be communicated to the Customer before confirmation where reasonably practicable.
Payment methods may include:
- credit or debit card
- online payment
- payment processed through a third-party payment provider
- other payment methods made available for the booking
A booking may not be confirmed until required payment has been received or successfully authorised.
16. CURRENCY AND EXCHANGE RATES
Prices may be displayed in Australian dollars or another currency depending on the booking channel.
Where payment is made in a different currency, the final amount charged may vary because of exchange rates, card issuer conversion rates, bank charges, payment provider fees or other applicable charges.
Customers are responsible for charges imposed by their own bank or card provider.
17. THIRD-PARTY PAYMENT PROVIDERS
Payments may be processed through third-party payment providers. Himalaya Wheels does not control the internal processing systems of third-party payment providers. Customers must comply with the applicable payment provider’s terms.
Where a payment provider declines, reverses or blocks a transaction, Himalaya Wheels may require an alternative payment method before confirming or continuing the booking.
18. BOOKING CHANGES
Requests to change a booking are subject to availability and the applicable booking conditions.
Changes may include rental dates, pickup or return time, vehicle, location, driver, service type or other booking details.
Additional charges may apply. A requested change is not effective until confirmed by Himalaya Wheels or the relevant Partner.
19. CANCELLATION AND REFUNDS
Cancellation rights, refund eligibility and applicable fees will depend on the cancellation conditions communicated with the booking.
Where a booking has specific cancellation conditions, those conditions will apply subject to applicable law.
Customers should contact Himalaya Wheels as soon as possible when seeking to cancel a booking.
Where a service cannot be provided as agreed, Himalaya Wheels will work with the relevant Partner to determine an appropriate solution, subject to applicable law and the relevant booking conditions.
20. NO-SHOWS
If a Customer fails to attend a scheduled pickup or otherwise fails to use a confirmed service without appropriate notice, the booking may be treated as a no-show.
No-show charges may apply according to the booking conditions.
Where a Customer is unable to attend due to circumstances outside their control, Himalaya Wheels may, where reasonably possible, assist in discussing available options with the Partner.
21. FUEL POLICY
The applicable fuel policy will be stated in the booking information where relevant.
Customers may be required to return the vehicle with the same or an agreed fuel level as at handover.
Fuel shortages, refuelling charges and applicable service fees may be charged to the Customer where permitted.
22. MILEAGE AND KILOMETRE LIMITS
Where a booking includes a kilometre or mileage limit, the applicable allowance and additional kilometre charges will be communicated to the Customer.
Additional mileage may be charged where the Customer exceeds the agreed allowance.
Where no mileage limit is stated, the applicable Partner conditions may apply.
23. LATE RETURN AND EARLY RETURN
Customers must return vehicles at the agreed date, time and location.
Late returns may result in additional rental charges, late-return fees, additional usage charges or other reasonable costs caused by the delay.
Customers should contact Himalaya Wheels or the Partner as soon as possible if they expect to be late.
Early return does not automatically entitle the Customer to a refund for unused rental time unless the applicable cancellation or booking conditions provide otherwise.
24. ONE-WAY RENTALS
One-way rentals are subject to availability and Partner approval.
Additional one-way, relocation, delivery or collection fees may apply.
The applicable charges will be communicated before confirmation where reasonably practicable.
25. VEHICLE SUBSTITUTION
If the booked vehicle becomes unavailable due to circumstances such as mechanical failure, accident, damage, maintenance, prior customer delay, operational issues or other circumstances affecting the Partner, Himalaya Wheels or the Partner may provide a reasonably comparable alternative where available.
If an appropriate alternative cannot be provided, available options may include a refund or other reasonable solution, subject to the circumstances, booking conditions and applicable law.
26. PROHIBITED USE
Unless expressly authorised, vehicles must not be used for:
- racing
- speed testing
- driving competitions
- carrying dangerous or unlawful goods
- unlawful passenger transportation
- commercial activity not authorised by the Partner
- sub-rental
- towing
- driving on prohibited roads or terrain
- any other prohibited activity communicated to the Customer
27. TRAFFIC, PARKING AND GOVERNMENT CHARGES
The Customer is responsible for charges arising from their use of the vehicle, including where applicable:
- traffic fines
- parking fines
- tolls
- government charges
- penalties
- impound or seizure charges
- towing charges
- other legally imposed charges resulting from the Customer’s use of the vehicle
28. ACCIDENTS AND INCIDENTS
Customers must promptly report any accident, collision, theft, attempted theft, damage or other significant incident to the relevant Partner and, where required, the appropriate authorities.
Customers must cooperate with police, insurers, Partners, Himalaya Wheels and other relevant authorities or service providers.
Customers must not admit liability or make settlement arrangements on behalf of a Partner or insurer unless authorised.
29. BREAKDOWNS AND ROADSIDE ASSISTANCE
Where a vehicle breaks down, the Customer should contact the Partner or designated assistance contact as soon as reasonably possible.
The Partner is generally responsible for operational assistance and roadside support relating to its vehicle, subject to the applicable booking conditions.
Customers should not arrange major repairs without appropriate authorisation except where immediate action is reasonably necessary for safety.
30. DAMAGE AND LOSS
The Customer may be responsible for damage, loss or additional costs caused by the Customer’s breach of these Terms, negligence, misuse, unauthorised use or failure to take reasonable care, subject to applicable law.
This may include damage to the vehicle, tyres, wheels, glass, interior, accessories, equipment or other Partner property.
Evidence such as photographs, inspection records, repair assessments and other relevant documentation may be used when assessing a claim.
31. INSURANCE AND DAMAGE PROTECTION
Insurance arrangements vary between Partners and services.
Where applicable, information about insurance, damage protection, excess or other coverage will be provided with the booking.
Customers should understand what is covered, applicable exclusions, excess amounts, security deposit requirements, claim procedures and circumstances that may invalidate or restrict coverage.
Nothing in these Terms guarantees that a Customer’s loss or liability will be covered by insurance.
32. ZERO OR REDUCED EXCESS
Where a booking specifically includes a zero-excess or reduced-excess option, that protection is subject to the applicable conditions and exclusions.
Zero or reduced excess does not necessarily cover every type of damage or loss.
Possible exclusions may include damage resulting from prohibited use, reckless or unlawful driving, unauthorised drivers, driving under the influence, deliberate damage, certain tyre, wheel or underbody damage, lost keys, lost accessories or other exclusions stated in the applicable protection conditions.
33. CORPORATE, NGO, EMBASSY AND ORGANISATIONAL BOOKINGS
Corporate, NGO, embassy and organisational bookings may be subject to specific quotations or agreements.
Where credit or invoicing is approved, payment terms will be stated in the applicable quotation, invoice or agreement.
The organisation making the booking remains responsible for ensuring that its authorised personnel comply with these Terms and applicable booking conditions.
34. LONG-TERM RENTALS
Long-term or extended rentals may be subject to additional conditions.
These may include periodic payments, additional security requirements, vehicle inspections, maintenance arrangements, mileage limits, re-authorisation of deposits or payment methods and other conditions communicated before confirmation.
35. FRAUD AND PAYMENT SECURITY
Himalaya Wheels may refuse, suspend or cancel a booking where there are reasonable concerns regarding fraud, unauthorised payment, identity verification, chargeback risk, misuse of payment methods or other security concerns.
Additional verification may be requested where reasonably necessary.
36. PERSONAL BELONGINGS
Customers are responsible for their personal belongings.
Himalaya Wheels and Partners are not responsible for personal property left inside vehicles except to the extent liability arises under applicable law.
Customers should check the vehicle carefully before returning it.
37. SMOKING, VAPING, ANIMALS AND CLEANLINESS
Smoking or vaping inside a vehicle may be prohibited.
Animals may only be transported where permitted by the applicable Partner and vehicle conditions.
Customers may be charged reasonable cleaning or restoration costs where excessive cleaning is required due to their use of the vehicle, subject to applicable law.
38. CUSTOMER CONDUCT
Customers must behave respectfully toward Partners, drivers, staff and other persons involved in providing the service.
Himalaya Wheels may refuse or discontinue assistance where a Customer engages in threatening behaviour, abusive behaviour, harassment, violence, unlawful conduct or conduct creating a safety risk.
Any action taken under this section remains subject to applicable law.
39. COMMUNICATION
Himalaya Wheels may communicate with Customers through email, telephone, SMS, WhatsApp, website messaging or other communication channels provided by the Customer.
Customers are responsible for providing accurate contact details and checking important booking communications.
40. CUSTOMER DATA
Himalaya Wheels may collect and use Customer information for purposes including processing enquiries and bookings, communicating with Partners, providing services, processing payments where applicable, customer support, fraud prevention, legal and regulatory compliance and other purposes described in the Himalaya Wheels Privacy Policy.
Information necessary to fulfil a booking may be provided to the relevant Partner or third-party service provider.
41. TOURS, EXPERIENCES AND TRAVEL SERVICES
Himalaya Wheels may facilitate enquiries or bookings for tours, sightseeing experiences, excursions, travel experiences and other travel-related services provided by independent third-party providers.
Where a third-party provider supplies the service, that provider is responsible for the physical delivery and operation of the relevant service.
Customers may be required to comply with the provider’s applicable booking conditions, cancellation policies, safety requirements, age restrictions, itinerary conditions and other service requirements.
Where Himalaya Wheels only provides an enquiry or referral service, submitting an enquiry does not constitute a confirmed booking.
Any booking, payment or other transaction will be subject to the terms communicated by the relevant third-party provider.
42. FLIGHT ENQUIRIES
Himalaya Wheels may provide a flight enquiry service through its website for domestic and international travel.
Customers may submit their flight requirements through the Himalaya Wheels website, including preferred travel dates, destinations, passenger requirements and other relevant information.
Himalaya Wheels acts only as an enquiry and referral platform for this service. Flight enquiries may be forwarded to an independent travel agent, airline, authorised travel provider or other third-party travel service provider (“Travel Provider”) for further assistance.
Himalaya Wheels does not directly sell, issue or ticket flights and does not collect or process Customer payments for flight bookings.
The relevant Travel Provider will deal directly with the Customer regarding flight options, availability, pricing, booking, payment, ticketing and other flight-related arrangements.
Submitting a flight enquiry does not constitute a confirmed booking and does not guarantee the availability of any particular flight, airline, fare, seat or itinerary.
Any flight booking made following an enquiry is subject to the terms and conditions, fare rules and policies of the relevant Travel Provider and/or airline. These may include conditions relating to payment, baggage, cancellation, refunds, amendments, rebooking, schedule changes and other applicable charges.
Customers are responsible for providing accurate information when submitting a flight enquiry, including passenger names, travel dates, destinations and other required details.
Customers are also responsible for ensuring that they hold all required passports, visas, transit permissions and other travel documentation necessary for their journey.
Once the enquiry has been forwarded to the Travel Provider, the Customer should deal directly with that Travel Provider regarding the proposed flight booking and any subsequent changes, cancellations, refunds, rebooking or other flight-related matters.
Himalaya Wheels may assist with communication or coordination where reasonably required, but does not control the availability, pricing, scheduling, operation or cancellation of flights provided by airlines or Travel Providers.
Nothing in this section excludes or limits any rights or remedies that cannot lawfully be excluded under applicable law.
43. TRAVEL DOCUMENTS AND ENTRY REQUIREMENTS
Customers are responsible for obtaining and maintaining all documents required for their travel.
These may include passports, visas, transit visas, permits, vaccination or health documentation where required, driver’s licences and other required travel documents.
Himalaya Wheels does not guarantee that a Customer will be permitted to enter or transit through any country.
Customers should obtain current information from the relevant government authorities, embassy, airline or service provider.
44. THIRD-PARTY SERVICES
Certain services arranged through Himalaya Wheels may be provided entirely or partly by third parties.
Third-party providers may have their own terms and conditions, cancellation policies, safety requirements, payment rules, insurance arrangements and service limitations.
Where applicable, those conditions will be communicated to the Customer.
45. LIABILITY AND CONSUMER RIGHTS
Himalaya Wheels will provide its own services with the level of care and skill required by applicable law.
Where a Partner or third-party provider supplies the physical service, Himalaya Wheels may assist with communication, coordination and resolution of service issues within its role.
To the extent permitted by law, Himalaya Wheels is not responsible for matters that are solely within the control of an independent Partner or third-party provider, including their acts or omissions, operational decisions or services.
However, nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory right, remedy or liability that cannot lawfully be excluded, restricted or modified under applicable law.
46. EVENTS OUTSIDE OUR CONTROL
Himalaya Wheels and Partners may be affected by circumstances outside reasonable control, including natural disasters, severe weather, floods, earthquakes, road closures, strikes, civil unrest, government restrictions, changes in laws, accidents, mechanical failures, airline disruptions, airport disruptions, traffic, security incidents, telecommunications failures or other unforeseen events.
Where such circumstances affect a booking, Himalaya Wheels will use reasonable efforts to assist the Customer in identifying available alternatives.
Nothing in this section limits any rights the Customer may have under applicable law.
47. CUSTOMER RESPONSIBILITY
Customers are responsible for providing accurate booking information, complying with these Terms, complying with applicable laws, meeting licence and eligibility requirements, taking reasonable care of vehicles and equipment, paying applicable charges and promptly reporting problems or incidents.
48. COMPLAINTS AND SERVICE ISSUES
Customers should contact Himalaya Wheels as soon as reasonably possible if they experience a problem with a booking.
Where the issue relates to a Partner-provided physical service, Himalaya Wheels may coordinate with the Partner to seek a reasonable resolution.
Customers should provide relevant evidence where available, including photographs, videos, receipts, booking information, correspondence and other supporting documents.
Himalaya Wheels will consider complaints reasonably and in accordance with applicable law.
49. DISPUTE RESOLUTION
If a dispute cannot be resolved through reasonable communication, the parties should first attempt to resolve the matter through good-faith discussion.
Where appropriate, the parties may consider mediation or another appropriate dispute-resolution process before commencing formal proceedings.
Nothing in this section prevents a Customer from exercising a statutory right or remedy available under applicable law.
50. GOVERNING LAW
These Terms are governed by the laws applicable to Himalaya Wheels and the relevant service, subject to any mandatory laws that apply to the Customer or the service.
Where a dispute concerns a service supplied in Nepal, applicable Nepalese laws may also apply to matters relating to that service.
Nothing in these Terms is intended to deprive a Customer of mandatory legal rights available to them.
51. SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or modified to the extent necessary to make it lawful where permitted.
The remaining provisions will continue to apply to the extent permitted by law.
52. NO WAIVER
If Himalaya Wheels does not immediately enforce a provision of these Terms, this does not mean that Himalaya Wheels has waived its right to enforce that provision later.
53. CHANGES TO THESE TERMS
Himalaya Wheels may update these Terms from time to time.
The version applicable to a booking will generally be the version accepted by the Customer at the time the booking is made, unless a change is required by law or otherwise applies to the booking.
The latest version will be made available through the Himalaya Wheels website.
54. ENTIRE AGREEMENT
These Terms, together with the applicable booking confirmation, quotation, service-specific conditions, cancellation policy, Privacy Policy and any other expressly incorporated terms, form the agreement relating to the relevant booking.
If there is a conflict between these Terms and a specific written booking condition provided to the Customer, the specific booking condition will apply to the extent of the inconsistency, subject to applicable law.
55. AUSTRALIAN CONSUMER LAW
Nothing in these Terms excludes, restricts or modifies any rights or remedies available to a Customer under the Australian Consumer Law or any other applicable law where those rights or remedies cannot lawfully be excluded.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value.
You are also entitled to be compensated for any other reasonably foreseeable loss or damage.
If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel the service contract and obtain a refund of any unused portion of the service.
The application of these rights will depend on the nature of the service and the circumstances of the relevant booking.
